Devcon Construction Inc. — Job Applicant Privacy Notice & Notice at Collection

This notice explains what personal information Devcon Construction Inc. (“Devcon,” “we,” “us”) collects when you apply for a job with us, how we use and retain it, whether we use artificial intelligence in reviewing applications, and the privacy rights you have. It applies to anyone who submits an application, resume, portfolio, or employment inquiry to Devcon, whether by email to hr@devcon-const.com, through a job board, or by any other means. Please read it before submitting your materials.

* Please do not include Social Security numbers, driver's license numbers, financial account numbers, date of birth, or photographs in your resume or portfolio. We do not need them to evaluate your application. Any sensitive personal information we receive is used only for purposes permitted by law (CCPA Regs. § 7027(m)) — such as evaluating you for employment where you volunteer it, providing accommodations, verifying eligibility to work, and legal compliance — and is never used to infer characteristics about you or sold or shared.

B. How we use applicant information

  • To receive, organize, and evaluate your application and communicate with you about it;

  • To verify information and conduct reference checks and, where applicable and with any legally required authorization, background checks (a separate notice and consent under the FCRA and California ICRAA will be provided at the stage);

  • To provide reasonable accommodations in the application process;

  • To comply with legal obligations (including equal employment opportunity recordkeeping, eligibility-to-work verification, and record-retention laws) and to exercise or defend legal claims; and

  • If you are hired, to begin your employment records. 

We do not sell applicant personal information, and we do not share it for cross-context behavioral advertising.

C. Our use of artificial intelligence

Devcon may use artificial intelligence tools — including Claude, an AI assistant developed by Anthropic — to help our recruiting team review, organize, and summarize, applications and resumes. Here is what that means, and what it does not mean: 

  • Humans make every hiring decision. AI is used only to assist tasks like summarizing documents and organizing candidate information. No applicant is rejected, ranked out, or advanced by an automated system acting on its own; a human recruiter or hiring manager reviews applications and makes all screening, interview, and hiring decisions. 

  • No automated significant decisions. We do not use AI to make decisions that produce legal or similarly significant effects about you without meaningful human involvement, and we do not use AI tools to infer protected characteristics or to analyze facial expressions, voice, or personality. 

  • Oversight and fairness. We use AI tools in a manner designed to comply with California's civil-rights regulations on automated-decision systems, including monitoring for and avoiding discriminatory impact, and we retain application records, including any data used with these tools, for at least four years as required by California law. 

  • Your alternatives. If you prefer that your application be reviewed without AI assistance, or if you need an accommodation in the application process, contact us at [hr@devcon-const.com] and we will provide a full human review at no disadvantage to you. You will not be treated adversely for making such a request. 

D. Where your information goes

Your application is received and stored in Devcon’s email and records systems (hosted by our IT service providers, such as Microsoft 365 and our email-security provider) and is accessible to our HR team and the hiring managers for relevant roles. We may disclose applicant information to service providers that support recruiting, IT, and security; to professional advisors; to background-check providers (only with separate notice and authorization); and to government authorities where required by law. Each service provider is contractually limited to using your information to provide services to us.

E. How long we keep it

We retain applications, resumes, and related records — including records of any AI-assisted review — for a minimum of four years from the date we receive them or from the date of the relevant employment action, as required by California Government Code § 12946. We retain records longer where a complaint, investigation, litigation hold, or other legal obligation requires it. If you are hired, your application becomes part of your personnel records and is retained per our employee record schedules.

F. Your privacy rights

If you are a California resident, you have the right to know/access, correct, and delete personal information we hold about you, subject to legal exceptions (for example, we cannot delete records the law requires us to keep for four years, but we will tell you what we withheld and why, and delete what the exceptions do not reach). We will never discriminate or retaliate against you — including in any hiring decision — for exercising your privacy rights. You may use an authorized agent. To submit a request, use any method in the “Contact” section below; we will verify your identity, confirm receipt within 10 business days, and respond within 45 calendar days (extendable once by 45 days with notice).

 

If you are a Nevada resident, you may review and request changes to covered information we hold about you, and you may submit a request directing us not to sell your covered information (we do not sell it) to our designated request address: privacy@devcon-const.com.
