1. Introduction and Scope
Devcon Construction Inc. is a California corporation headquartered in Milpitas, California, providing construction services in California and Nevada. This Privacy Policy describes how we collect, use, disclose, and retain personal information when you visit www.devcon-const.com, contact us by email or telephone, or otherwise interact with us online, and it explains the privacy rights available to you and how to exercise them.
This Policy dos not apply to information we collect from our employees in their capacity as employees. If you apply for a job with Devcon, our Job Applicant Privacy Notice (available on our Careers page) applies to the information you submit, in addition to this Policy.
This Policy explains: (1) the personal information we collect and why; (2) how we disclose it; (3) cookies and similar technologies; (4) how long we keep personal information; (5) your rights under California law; (6) your rights under Nevada law; (7) information for visitors from other states; and (8) how to contact us.
2. Notice at Collection — Personal Information We Collect
The table below serves as our notice at collection under California Civil Code § 1798.100(a) and § 7012 of the CCPA regulations. It lists the categories of personal information (as defined in Civil Code § 1798.140(v)) that we have collected in the preceding 12 months, with examples, sources, purposes, and retention. We do not collect or process sensitive personal information through the Site itself, except to the extent a person voluntarily includes it in an email to us (see Section 3). We do not sell personal information, and we do not share it for cross-context behavioral advertising.

What we do not collect: The Site contains no account registration, payment, or e-commerce functionality. We do not collect biometric information, precise geolocation, or the contents of private communications other than those you send to us. We do not knowingly collect personal information from children (see Section 12).
3. Sensitive Personal Information
We do not ask for sensitive personal information through the Site, and we ask that you not include Social Security numbers, driver’s license numbers, financial account numbers, health information, or similar sensitive information in emails to us unless we specifically request it through a secure channel. Any sensitive personal information we do receive is used only for purposes permitted by § 7027(m) of the CCPA regulations — such as performing services you request, security and integrity, and legal compliance — and is never used to infer characteristics about you. Because of this, we are not required to offer a “Limit the Use of My Sensitive Personal Information” link; if our practices change, we will offer one.
4. Sources of Personal Information

Directly from you — when you email us (including contact@devcon-com, our project contacts, or hr@devcon-const.com), call us, or submit a search query on the Site.

Automatically from your device — our website platform (Wix.com Ltd.) collects technical and usage data on every page view, as described in Sections 2 and 7.

From service providers — such as our website platform, email and IT security providers, which process information on our behalf.
We do not buy personal information from data brokers, and we do not collect personal information about you from social networks or advertising companies.
5. How We Use Personal Information (Business and Commercial Purposes)

To operate, maintain, secure, and debug the Site, including detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity;

To respond to your inquiries and communicate with you about projects, sercives, or your requests;

We do not use personal information for automated decision-making that produces legal or similarly significant effects concerning consumers, and we do not use it for profiling for behavioral advertising.
6. How We Disclose Personal Information
We do not sell personal information, and we have not sold it in the preceding 12 months. We do not share personal information for cross-context behavioral advertising, and we have not done so in the preceding 12 months. We have no actual knowledge of selling or sharing the personal informaiton of consumers under 16 years of age.

Our service providers and contractors are bound by written contracts that restrict their use of personal information to the services they perform for us. We may also disclose personal information as required by law, to protect our rights or the safety of others, or in connection with a corporate transaction such as a merger or asset sale (in which case this Policy will continue to apply to previously collected information unless you are notified otherwise).
7. Cookies and Similar Technologies
The Site uses cookies and similar technologies. Cookies that are strictly necessary — for security, load balancing, session continuity, and remembering your cookie preferences — are always active. Other categories are off by default and are used only if you enable them through the cookie banner or the “Cookie Settings” link in the Site footer.

No advertising cookies. We do not use advertising, retargeting, or social-media tracking cookies, and no third party is permitted to collect personal information about your online activities over time and across different websites or online services through our Site for its own pusposes.
Do Not Track and opt-out preference signals. Because we do not sell personal information or sharee it for cross-context behavioral advertising, and do not engage in cross-site tracking, there is no sale or sharing for a browser signal to opt you out of. The Site does not currently respond to "Do Not Track" browser signals, for which no industry standard has been adopted. If we ever begin selling or sharing personal information, we will honor opt-out preference signals such as Global Privacy Control as required by California law and will update this Policy and our banner accordingly.
8. How Long We Keep Personal Information
We retain each category of personal information for no longer than is reasonably necessary for the disclosed purposes, using the retention periods stated in Section 2. In general: website telemetry and analytics data are retained per our platform provider’s schedule (up to 25 months); general inquiry correspondence is retained for 24 months after the matter closes; business and project records are retained for the duration of the relationship plus the period required by applicable statutes of limitation and record-retention laws; and job application materials are retained for at least four years as required by California Government Code § 12946, or longer where a legal hold or dispute requires it. When a retention period ends, we delete, deidentify, or securely destroy the information.
9. Your California Privacy Rights
If you are a California resident, the CCPA/CPRA gives you the following rights, subject to certain exceptions:

Right to know / access. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes, and the categories of recipients to which we disclosed it. You may request information covering the period beginning January 1, 2022, and may specify a date range for your request.

Right to delete. You may request that we delete personal information we collected from you, subject to statutory exceptions (for example, records we must keep to comply with legal obligations, including employment record-retention laws).

Right to correct. You may request that we correct inaccurate personal information.

Right to opt out of sale or sharing. We do not sell personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of. If this changes, we will provide a “Do Not Sell or Share My Personal Information” link and honor opt-out preference signals before any sale or sharing occurs.

Right to limit use of sensitive personal information. We use sensitive personal information only for purposes permitted by § 7027(m) of the CCPA regulations, so this right does not currently apply.

Right to non-discrimination and non-retaliation. We will not discriminate or retaliate against you for exercising your rights — including if you are a job applicant, employee, or business contact.

Verification, authorized agents, and timing
We must verify your identity before responding to a request to know, delete, or correct. We will match information you provide against information we maintain — typically at least two data points (such as your email address and the approximate date of your interaction with us), and, for requests seeking specific pieces of information, a signed declaration under penalty of perjury that you are the consumer in question. We will use information you submit for verification only for that purpose. If we cannot verify your identity to the required degree of certainty, we will tell you why.
You may designate an authorized agent to submit a request on your behalf by providing the agent with signed written permission or a power of attorney; we may still require you to verify your own identity or confirm the agent’s authority.
We will confirm receipt of your request within 10 business days and respond substantively within 45 calendar days, extendable once by an additional 45 days with notice to you. We will maintain records of consumer requests as required by the CCPA regulations. If we deny a request in whole or in part, we will explain the basis for the denial and, where applicable, honor the portions we can.
California “Shine the Light”
California Civil Code § 1798.83 permits California residents to request information about disclosure of personal information to third parties for those parties’ direct marketing purposes. Devcon does not disclose personal information to third parties for their direct marketing purposes. 10. Your Nevada Privacy Rights
This section, together with this Policy as a whole, constitutes our notice under Nevada Revised Statutes § 603A.340. The categories of covered information we collect and the categories of third parties with whom we may share it are described in Sections 2 and 6. You may review and request changes to covered information we hold about you by contacting us through any method in Section 9. We will notify consumers of material changes to this notice as described in Section 14. No third party collects covered information about your online activities over time and across different Internet websites through our Site. The effective date of this notice appears at the top of this Policy.
Nevada law (NRS § 603A.345) also gives Nevada consumers the right to direct an operator not to sell their covered information. Nevada defines a “sale” as the exchange of covered information for monetary consideration to a person who will further license or sell it. Devcon does not sell covered information as so defined, and has no plans to. Nonetheless, you may submit a verified opt-out request through our designated request address: privacy@devcon-const.com, with “Nevada Opt-Out Request” in the subject line. We will respond within 60 days of receiving a verified request (extendable by up to 30 days where reasonably necessary, with notice to you), and we will honor your request should our practices ever change.
11. Visitors From Other States
Devcon builds projects in California and Nevada, but our Site is available to visitors anywhere. If you reside in another state whose privacy law grants you rights in personal information we hold (for example, rights of access or deletion), you may submit a request using the methods in Section 9, and we will honor rights that applicable law grants you. Most state privacy laws apply only to businesses that meet thresholds concerning residents of that state; where a law does not apply to Devcon, we may still choose to honor reasonable requests as a courtesy.
12. Children
The Site is a business-to-business site not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, please contact us and we will delete it.
13. How We Protect Personal Information; Third-Party Links
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure, consistent with NRS § 603A.210 and California law. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. The Site contains links to external websites and services (for example, mapping services and sign-in portals for third-party applications used by our employees and partners). Those sites operate under their own privacy policies, which we encourage you to review; this Policy does not apply to them.
14. Changes to This Policy
We review this Policy at least once every 12 months and update it as our practices or legal requirements change. When we make changes, we will revise the “Last updated” date above; if the changes are material, we will provide additional notice by posting a prominent statement on the Site’s homepage for at least 30 days before the change takes effect. Your continued use of the Site after the effective date of a revised Policy indicates that you have had an opportunity to review it.
15. Accessibility
This Policy is intended to be accessible to consumers with disabilities and to conform to recognized accessibility standards (WCAG 2.1). To request this Policy in an alternative format, contact us using the methods in Section 9.
